These General Terms and Conditions of Sale govern access to, browsing of, and use of the website www.somechic.com (the “Website”), as well as the contractual relationship arising from the purchase of products offered through it.
The Website is owned and operated by MIRSY RETAIL S.L., a company incorporated under Spanish law, with registered office at Calle Bori i Fontestà 19, Local, 08021 Barcelona, Spain, and tax identification number B-67026419 (hereinafter, “MIRSY RETAIL”, “we”, “us” or “our”).
MIRSY RETAIL S.L. operates commercially under the brands SOMECHIC and SOMECHIC STUDIO.
By accessing or using this Website, you agree to be bound by these General Terms and Conditions, the Privacy Policy, and the Legal Notice. If you do not agree, you must refrain from using the Website.
These Terms may be amended at any time. The version applicable to you will be the one published on the Website at the time the order is placed.
SECTION 1 – WEBSITE OWNERSHIP AND INTELLECTUAL PROPERTY
All intellectual and industrial property rights relating to the Website and its contents, including trademarks, logos, designs, texts, images, photographs, videos, software, and source code, are owned by or licensed to MIRSY RETAIL S.L.
Access to the Website does not grant any rights over such intellectual or industrial property. Any reproduction, modification, distribution, public communication, or commercial use without prior written authorization is strictly prohibited.
MIRSY RETAIL S.L. reserves the right to take legal action against any infringement of its rights.

SECTION 3 – TERMS OF USE AND ELIGIBILITY
Products offered through the Website are intended exclusively for end users, defined as individuals acting outside a commercial, business, or professional activity.
MIRSY RETAIL S.L. reserves the right to refuse or cancel orders that do not meet this requirement.
SECTION 4 – USER ACCOUNT REGISTRATION
To place an order, users may be required to create an account. Only individuals over 18 years of age with full legal capacity may register.
Users are responsible for maintaining the confidentiality of their login credentials. Any activity carried out through the account will be deemed to have been performed by the registered user.
SECTION 5 – USER OBLIGATIONS
Users agree to:

- Not place fraudulent or speculative orders
- Use the Website in accordance with applicable law
- Pay the full price of purchased products, including shipping costs

SECTION 7 – CONTRACT FORMATION AND ORDER ACCEPTANCE
Product listings constitute an invitation to treat and do not represent a binding offer.
Order confirmation emails generated automatically by our e-commerce platform do not constitute acceptance of the order.
A contract is formed only when you receive an email confirming that your order has been shipped (“Shipping Confirmation”).
If an order is rejected after payment, the full amount paid will be refunded.
Contracts may be concluded in Spanish or English.
SECTION 8 – RIGHT OF WITHDRAWAL AND RETURNS
You have the right to withdraw from the contract within fourteen (14) calendar days from the date you or a third party designated by you acquires physical possession of the goods.
Upon valid withdrawal, MIRSY RETAIL S.L. will refund all payments received from you, excluding delivery costs, provided that the return is made through the online return procedure.
For online returns processed by courier or home collection, refunds will be issued using the same payment method used for the original purchase, in accordance with PayPal and card payment regulations.
If the recipient of the products differs from the person who made the payment, the refund will be issued to the person who paid for the order.
If only part of an order is returned, only the corresponding amount will be refunded. Delivery costs will not be refunded, as they are calculated per order.
Return methods
Returned products must be unused, in perfect condition, and returned with original packaging, tags, and accessories.
Returns may be made using one of the following methods:
a) Return in a physical store
If you choose to return an online purchase in one of our physical stores, the refund will be issued exclusively as a store credit (voucher) with no expiration date, redeemable only in physical stores.
No cash or card refunds will be made in-store for online purchases.
b) Home collection or courier return (Mainland Spain and Balearic Islands)
A €5 collection fee will be deducted from the refund, which will be processed using the same payment method used for the original purchase.
c) International or self-arranged returns
Returns made from other countries or arranged by the customer must be made at the customer’s expense. Cash-on-delivery shipments will not be accepted.

Conditions of return
You are responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, or functioning.
Products that are damaged, used, incomplete, or soiled due to customer negligence will not be refunded and will be returned at the customer’s expense.
Refunds will be processed as soon as possible and, in any event, within fourteen (14) calendar days from the date we are informed of your decision to withdraw. MIRSY RETAIL S.L. may withhold the refund until the goods are received or proof of return is provided.
Exclusions from the right of withdrawal
The right of withdrawal does not apply to:
- Customized or personalized products once production has begun
- Underwear and swimwear that have been unsealed after delivery, for hygiene reasons
SECTION 9 – PRODUCT AVAILABILITY
All orders are subject to product availability. If a product becomes unavailable, you will be informed and refunded if payment has already been made.
SECTION 10 – PURCHASE PROCEDURE
The Website guides users through product selection, order summary, personal data entry, shipping details, payment, and final confirmation.
SECTION 11 – SHIPPING
Orders are shipped from Spain via courier service. Delivery times may vary by destination but will not exceed 15 business days.
Shipping costs are calculated at checkout and exclude customs duties or taxes applicable in the destination country.
SECTION 12 – DELIVERY ISSUES
Shipping status updates provided through the “My Account” area are for informational purposes only and may be subject to delays beyond our control.
If delivery fails due to incorrect information or customer inaction, return shipping costs may be deducted from the refund.
SECTION 13 – TRANSFER OF RISK AND OWNERSHIP
Ownership and risk of loss or damage pass to the customer at the moment the products are physically delivered.
SECTION 14 – PRICES, TAXES, AND PAYMENT METHODS
All prices are shown in euros (€) and include applicable VAT unless otherwise stated.
Invoices will be issued upon customer request.
Payments may be made by credit/debit card or PayPal using secure, encrypted systems.
SECTION 15 – DEFECTIVE OR INCORRECT PRODUCTS
If you receive a defective or incorrect product, please contact us within 24 hours. Approved returns will be fully refunded, including shipping costs.
SECTION 16 – GIFT OPTION
Gift purchases may include a personalized message. Refunds for returned gifts will be issued to the original purchaser.
SECTION 17 – PURCHASE LIMITS
Orders exceeding €3,000 or 30 items within a 15-day period may require additional verification.
SECTION 18 – PRODUCT INFORMATION
We strive to display products as accurately as possible; however, minor variations may occur due to screen settings.

Nothing in these Terms limits liability that cannot be excluded under applicable law.
SECTION 20 – FORCE MAJEURE
MIRSY RETAIL S.L. shall not be liable for delays or failures caused by events beyond reasonable control.
SECTION 21 – APPLICABLE LAW AND JURISDICTION
These Terms are governed by Spanish law. Disputes shall be submitted to the courts of the consumer’s place of residence or, where applicable, to the courts of Barcelona, Spain.
SECTION 22 – B2B SALES (WHOLESALE)
Sales made to professional customers, retailers, distributors, or commercial agents, whether carried out through B2B wholesale platforms such as Faire or through direct contact with our Wholesale team, sales representatives, or authorized distributors, are governed exclusively by specific B2B terms and conditions. Consumer protection regulations, including the right of withdrawal, do not apply to B2B transactions. Returns, cancellations, payment terms, minimum order quantities, pricing, delivery conditions, and any other applicable commercial terms shall be governed by the relevant wholesale agreement, the terms of the B2B platform used, or the conditions agreed directly with our commercial team.
